This document (the "Agreement") is a legally binding agreement between you and HeadOn Health LTD, a company registered in Scotland under number SC622639, that governs your use of the online and mobile services associated with HeadOn Health, including www.headon-health.com. You must read and agree to the terms and conditions of this agreement before you access our website, you are agreeing to be bound by these terms.

When we refer to "we", "us" or "our" in this policy, we are referring to Headon Health Limited. The terms "you", "your" and "yours" when used in these terms mean any user of the website.

Contract information

By using the website you confirm you are 18 years of age or over, that all registration information you submit to us is true, accurate and complete, and that you will update this information in order to keep it current, that you have read our privacy policy. you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws.

Understanding HeadOn Health

HeadOn is not a medical device. It provides education and general information about concussion. Information provided on post-concussion recovery is based on general health and wellbeing advice (such as good sleep hygiene, alcohol consumption reduction, exercising and not smoking). HeadOn allows you to monitor your health with a symptom tracker but does not provide treatment recommendations based on the information you provide. You acknowledge and agree our website should not be used as a medical device or in place of professional medical advice. You acknowledge HeadOn is a self help program to help guide you through your own journey recovering from a concussion.

All information on our apps and website has been created as an educational resource, and should not be used as a substitute for proper and personalised professional medical advice or be used to make decisions about your health. If you receive advice from a doctor or other qualified medical professional which conflicts with anything contained in the website then the former should take precedence.

We also cannot answer any medical queries either through via email or any other means.

Grant of right of use

Unless otherwise specified, we grant you a limited, non-exclusive, non-transferable, revocable right to make personal non-commercial use only of that content and those features of the website, provided that you comply fully with the provisions of this Agreement.

Your health and HeadOn

We recommend and advise you seek the advice of a doctor before undertaking any health program attention. HeadOn is not recommended for patients who have had a severe acquired brain injury or mental health problems that required in-patient care.

Clinicians do not monitor the data put into this website and if you have any concerns regarding your physical or mental health you should seek medical attention.

No warranty

We regularly review our educational material to ensure they are up-to-date and meet a reasonable standard of accuracy. However, the materials on our website are provided on an ‘as is’ basis with no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Further, we do not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

The use of the website (including but not limited to their content and features) is at your own risk. HeadOn Health shall not be liable to any person for any loss or damage of any kind, which may arise, directly or indirectly from the use of or inability to use any of the information contained in any of the materials on the website. There is no guarantee of availability of information on the website at any time, nor that it is up to date or error-free.

Limited Liability

In no event shall we be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on our website or apps, even if we or an authorized representative has been notified orally or in writing of the possibility of such damage. In order to access the program you may be required to register personal information and create a unique password. You are responsible for maintaining the confidentiality of your password.

We are registered with the UK Information Commissioner's Office as a Data Controller (Reg No. ZA529669), and have in place a comprehensive Company data protection policy and code of practice.

Intellectual Property

The materials contained in this website are protected by applicable UK and international copyright and trademark laws.

We may make software owned or operated by third-party companies available to you. You must only use this software in accordance with the terms and conditions imposed by the third-party provider.

We have not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by us or the site. Use of any such linked website is at the user’s own risk

Technology limitations and modifications

HeadOn Health LTD will make reasonable efforts to keep the Website operational. However, certain technical difficulties, maintenance, or any other cause beyond our reasonable control (including (but not limited to) failure of the internet, natural disaster, labor shortage or dispute, or governmental act) may, from time to time, result in interruptions. HeadOn Health LTD reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, functions and features of the website with or without notice. You agree not to hold us liable for any such failure or delay in performance and we agree to make all reasonable efforts to restore the website (or any part thereof) as soon as practicable.

Term and termination

This Agreement is between you and us only and will become effective when you start using the website and will remain effective until terminated by you or HeadOn Health. HeadOn Health reserves the right to terminate this Agreement or suspend your HeadOn account at any time in case of unauthorized, or suspected unauthorised use of the website whether in contravention of this Agreement or otherwise. If HeadOn Heath LTD terminates this Agreement, or suspends your HeadOn account, for any reason, HeadOn Health LTD shall have no liability or responsibility to you whatsoever, and HeadOn Health shall not refund any amounts that you have paid.
